Terms of service

These terms govern your use of puffrate.com and everything Puff Rate operates under it (together, "the Services"). By using the Services, you agree to these terms, the privacy policy, the cookie policy, and the house rules. If you don't agree, don't use the Services.

Who can use Puff Rate

You must be at least 21 years old — or the legal minimum age to purchase tobacco products in your jurisdiction, whichever is higher. See 21+ only for the full statement. You're also responsible for making sure your use of the Services is legal where you live.

What Puff Rate is — and isn't

Puff Rate documents cigars and hosts member reviews and ratings. We don't sell tobacco, don't ship anything, and aren't a store. Nothing on the site is an offer to sell tobacco or nicotine products, and nothing here is medical advice.

Your account

Some features require an account. Keep your credentials to yourself, keep your account information accurate, and tell us through the contact form if you think someone else has access to your account. You're responsible for what happens under it.

Your content

Reviews, ratings, photos, edits, and everything else you contribute stays yours. By posting it, you grant Puff Rate a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute it as part of operating the Services — showing your review on a cigar's page, including it in search results, and folding it into aggregate summaries of what the room thinks (including AI-assisted profiles built from member reviews).

You're responsible for what you post. Only contribute content you have the right to share, and keep it within the house rules. We may remove content that breaks these terms or the rules. If you delete your account, we remove or anonymize your profile; see the privacy policy for how deletion works.

What you can't do

In short: don't wreck the room. Specifically, you may not:

• Post content that is illegal, defamatory, harassing, or infringes someone else's rights.
• Misrepresent who you are, shill for a brand without disclosure, or post fake reviews.
• Use the Services to sell, advertise, or facilitate the sale of tobacco or nicotine products.
• Scrape, harvest, or bulk-copy the database or member content — see fair use for the quoting that is welcome.
• Probe, disrupt, or attempt unauthorized access to the Services or other members' accounts.

Our content

The Puff Rate name, design, software, and the structure and curation of the cigar database belong to Puff Rate. We give you a limited, revocable license to use the Services for personal, non-commercial purposes. Cigar brand names, band artwork, and product imagery belong to their respective owners — see fair use and copyright for how we handle that.

Third-party links

The Services may link to sites we don't control. We're not responsible for their content, policies, or practices.

Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. Reviews and ratings are member opinions. Cigar data is community-maintained and may contain errors — a single review settles a lot, but not everything.

Limitation of liability

To the fullest extent permitted by law, Puff Rate is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Where liability can't be excluded, it's limited to the amount you paid us to use the Services in the twelve months before the claim — which, for most members, is nothing.

Indemnification

If your content or your use of the Services causes a third-party claim against Puff Rate, you agree to indemnify us for the resulting losses and reasonable legal costs.

Termination

You can stop using the Services or delete your account at any time. We may suspend or terminate accounts that violate these terms or the house rules. Sections that by their nature should survive termination — content licenses for what remains published, disclaimers, liability limits — survive it.

Changes to these terms

We may update these terms as the Services evolve. When we do, we'll change the date at the top of this page; for material changes, we'll make the update visible on the site. Continued use after a change means you accept the new terms.

Governing law

These terms are governed by the laws of the United States and the state where Puff Rate is operated, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that state.
